Building Location Restrictions

The following setbacks are required for residential and
private use buildings: |
Front
County: 30’ from road right of way or property line
Cities: 20’ from road right of way or property line |
Side Street County: 30’ from road right of way or property line Cities: 20’ from road right of way or property line
Exception: In Rupert the side street setback may be reduced to ten feet
when no other building on the block or the adjacent block
uses the side street as a front street.

County: 5’ from property line
Cities: 5’ from property line |
Rear
County: 5’ from property line
Cities: 5’ from property line |
Exceptions:

In Heyburn when garage doors face an
alley, a twenty-foot setback is required.

In Rupert storage or out building may be located on a
rear property line when there is an alley, but may not have
projections over the alley right of way.
In addition to setback requirements no buildings are allowed
to be located or constructed on easements, unless they are
under 120 square feet are not placed on a permanent
foundation and are readily moveable. Specifics for easements
are recorded with deeds and are usually part of the
information obtained at the time of purchase. This
information can also be obtained from the applicable City’s
public works department.
Note: It is the responsibility of the owner to be aware of
all applicable easements. If property lines are not easily
discernible a survey will be required at the expense of the
owner.
