The civil law division for Minidoka County handles all paper services for executions, small claims, subpoenas, court orders, and summons. We also handle Warrants of Distraints for the Minidoka Co. Tax Collector.

Papers Required to Execute a Garnishment, or Execution

The Sheriff’s office will not accept your Writ of Execution unless the following are included.
  • Letter of Instruction: Be specific, include what you want us to do, for example pick up personal or real property (describe what you want picked up.) Or Garnish payroll, or execute on a bank account. Must be signed!
  • Writ of Execution: The original, and 2 copies
  • Order: 3 copies
  • Continuous Execution: (Motion & Order of) 3 copies
  • Notice of Garnishment: Must include the correct name and physical address of the Garnishee
  • Envelope: Stamped and addressed with the last know address of the defendant—and one for any third party. 
  • Search Fee: For cases involving a bank garnishment, your letter must include the Branch, account number, Social Security Number if know and a $5.00 non-refundable search fee made out to the branch.
  • Exemption Packet: Notice of Exemptions, instructions to defendants & third parties. Exemptions entitled, and claim of Exemption form.
  • Instructions from Judgment Creditor: Including information such as last know address of defendant, and any third party with an interest in property.
In cases where you want vehicles or property picked up, we must be aware of any liens or third parties associated with the property. All towing and storage unit fees must be paid in advance. It is up to you to make prior arrangements for these services and forward the information to us.

If a claim of exemption is filed with the Sheriff’s office and a court date is set, all proceeds will be held until after the court hearing.

Please call for amount of fees, and to check if there is a garnishment in effect for the defendant before sending them to this office. In the event that there is an existing garnishment for the defendant, this could save extra expense for postage.
